Location-Based Service Terms

These Terms are intended to set forth the rights, obligations, responsibilities, and other necessary matters between Asin Tour Co., Ltd. (hereinafter the "Company") and the personal location information subjects who use the location-based service (hereinafter "Users") provided by the Company.

Article 1 (Purpose of the Terms)

These Terms are intended to set forth the rights, obligations, responsibilities, and other necessary matters between the Company and customers who use the location-based service (hereinafter the "Service") provided by the Company.

Article 2 (Effect and Amendment of the Terms)

  1. These Terms take effect when a customer or personal location information subject who has applied for the Service agrees to these Terms and registers as a user of the Service in accordance with the procedures prescribed by the Company.
  2. The Company may amend these Terms as necessary, provided that such amendment does not violate relevant laws.
  3. If the Terms are amended, the Company will announce the changes at least 7 days before their effective date through the Company's website or Service notices.

Article 3 (Content of the Service)

The content of the location-based service provided by the Company is as follows:

  1. Location-Based Game Services
    • Providing eco-tourism games based on the current location
    • Verification service for visits to specific tourist sites
    • Searching for and recommending nearby eco-tourism sites
  2. Collection and Use of Location Information
    • Real-time collection of location information via GPS
    • Location verification for confirming completion of game missions
    • Generating visit records and statistics
  3. Provision of Customized Content
    • Customized game recommendations based on the current location
    • Providing information on nearby eco-tourism attractions

Article 4 (Use or Provision of Personal Location Information)

  1. If the Company intends to use personal location information to provide the Service, it must specify this in advance in the terms of use and obtain the consent of the personal location information subject.
  2. Except in the following cases, the Company does not provide personal location information to third parties without the consent of the personal location information subject:
    • Where the personal location information subject has consented
    • Where required by law, or where a request is made by an investigative agency in accordance with the procedures and methods prescribed by law for investigative purposes
  3. When the Company provides personal location information to a third party designated by the personal location information subject, the Company will immediately notify the personal location information subject, via the communication device used to collect the information, of the recipient, the date/time, and the purpose of provision, each time such information is provided.

Article 5 (Rights of Personal Location Information Subjects)

  1. A personal location information subject may, at any time, withdraw all or part of their consent to the provision of location-based services using personal location information and to the provision of personal location information to third parties.
  2. A personal location information subject may, at any time, request the Company to temporarily suspend the collection, use, or provision of personal location information.
  3. A personal location information subject may request the Company to allow inspection of, or notify them of, the following data, and may request correction if there is an error in such data:
    • Records confirming the collection, use, and provision of location information regarding the personal location information subject
    • The reasons and details for which the personal location information subject's personal location information was provided to a third party under the Act on the Protection and Use of Location Information or other laws
  4. A personal location information subject may exercise the rights under Paragraphs 1 through 3 through the procedures prescribed by the Company.

Article 6 (Rights of Legal Representatives)

  1. If the Company intends to use or provide to a third party the personal location information or records confirming the use/provision of location information of a personal location information subject under the age of 14, beyond the scope specified or notified in the terms of use, the Company must obtain the consent of both the personal location information subject under age 14 and their legal representative.
  2. A legal representative who intends to consent to the provision of location-based services using the personal location information of a personal location information subject under age 14, and to the provision of such information to third parties, must undergo an identity verification procedure.

Article 7 (Basis and Period for Retaining Records Confirming the Use/Provision of Location Information)

The Company automatically records and retains data confirming the collection, use, and provision of location information regarding personal location information subjects, in accordance with Article 16, Paragraph 2 of the Act on the Protection and Use of Location Information, and such data is retained for at least 6 months.

Article 8 (Change and Suspension of the Service)

  1. If the Company is unable to maintain the Service due to changes in the policies of location information providers, or due to other circumstances of the Company or legal impediments, the Company may restrict, change, or suspend all or part of the Service.
  2. In the event of a Service suspension under Paragraph 1, the Company will provide advance notice via the internet or notify personal location information subjects directly.

Article 9 (Protection of Personal Location Information)

The Company takes the following protective measures to safely manage personal location information:

  1. Establishment and implementation of an internal management plan: An internal management plan is established and implemented for the safe processing of personal location information.
  2. Access control and restriction of access rights to personal location information: The Company takes necessary measures to control access to personal location information by granting, changing, and revoking access rights to the systems that process it, and controls unauthorized external access using an intrusion prevention system.
  3. Retention of access records: Records of access to the personal location information processing system are retained and managed for at least 6 months.
  4. Encryption of personal location information: Personal location information is safely stored and managed through encryption and other means.

Article 10 (Rights of Guardians of Children Aged 8 or Under, etc.)

  1. The Company deems that consent has been obtained when the guardian of a person falling under the following categories (hereinafter "children aged 8 or under, etc.") consents to the use or provision of personal location information for the protection of the life or body of such children, etc.:
    • A child aged 8 or under
    • A person under adult guardianship
    • A person with a mental disability under Article 2, Paragraph 2, Subparagraph 2 of the Act on Welfare of Persons with Disabilities, who is a person with a severe disability under Article 2, Subparagraph 2 of the Act on Employment Promotion and Vocational Rehabilitation for Persons with Disabilities (limited to those registered as disabled under Article 32 of the Act on Welfare of Persons with Disabilities)
  2. A guardian who intends to consent to the use or provision of personal location information for the protection of the life or body of a child aged 8 or under, etc. must submit a written consent form to the Company, together with documentation proving guardianship status.

Article 11 (Compensation for Damages)

  1. If a user suffers damages as a result of the Company's violation of Articles 15 through 26 of the Act on the Protection and Use of Location Information, the user may claim compensation for damages against the Company.
  2. The Company may limit its liability to the extent permitted by law.

Article 12 (Dispute Mediation)

  1. If a dispute concerning location information cannot be resolved or agreed upon between the Company and a user, the Company may apply for adjudication to the Korea Communications Commission.
  2. If a dispute concerning location information cannot be resolved or agreed upon between the parties, the Company or the user may apply for mediation to the Personal Information Dispute Mediation Committee in accordance with the Personal Information Protection Act.

The Company designates and operates a person in a position of substantive responsibility, who can appropriately manage and protect location information and smoothly handle user complaints, as the Location Information Manager.
